Viscount St Davids abandons appeal, goes back to prison

We looked previously at the conviction and 12 week prison sentence of Rhodri Phillips, the 4th Viscount St Davids, as well as his being bailed pending his appeal that was due at the beginning of August, but seems to have been rescheduled to 25th August 2017.

On that day, we learned that the Viscount had decided to abandon his appeal after the Judge reminded him (correctly) that the Court could increase his sentence.

This is a rare provision, but if the Crown Court is anything like the Court of Appeal, then it will be used increasingly frequently (see our factsheet on appeals here).

We don’t have much details of Viscount St Davids thought processes, or whether he was represented,but the BBC reported that “Judge Deborah Taylor told Southwark Crown Court it was the court’s “preliminary view” the viscount’s sentence could be increased, and Philipps abandoned his appeal about 15 minutes later.

So that is that for this case. His Lordship will have to serve the remainder of the sentence, but the time he spent on remand in advance will count.
